On 2 June 2022, the Court of Justice of the European Union, in judgment C-617/20 T.N., with the intervention of Italy, clarified that the renunciation of the inheritance made by an heir before a court of his own State of habitual residence is valid even if it does not comply with the formal requirements of the law applicable to the succession in another E.U. Member State.
