On May 5th, 2022, the EU Parliament certified the 2020 expenditure compliance of most EU entities, with the exception of Frontex, the European Economic and Social Committee and the EU Council. The decision, as the MEPs explain in the resolution accompanying the measure, is based on the failure to comply with the conditions set out in the previous Parliament’s discharge report, as well as on the ongoing investigations of the European Anti-Fraud Office (OLAF) on events relating to respect for fundamental rights, including the push-backs of migrants. MEPs state that they have not been able to read the full investigation report and are therefore unable, at present, to make an informed decision. Before the vote, the rapporteur Tomáš Zdechovský (PPE, CZ) reported that Frontex had to operate in difficult circumstances and there is the need for effective management and greater accountability. The rapporteur also stressed that they currently do not have enough information to make an informed decision on granting discharge. However, in the accompanying resolution, MEPs ask the Court to resolve a number of ethical and financial management issues involving its members and the President and which have caused damage to the Court’s reputation. and raised doubts about its impartiality.
