On January 31, 2022, the public consultation on the guidelines 05/2021 adopted by the European Data Protection Committee (“EDPB”) was concluded, which clarify the definition of international data transfer pursuant to Regulation (EU) 2016/679 relating to the protection of individuals with regard to the processing of personal data (GDPR). The EDPB 05/2021 guidelines are intended to support organizations in interpreting the combined provisions of art. 3 of the GDPR, which establishes the territorial scope, and of the provisions of Chapter V of the same GDPR, aimed at ensuring that the level of protection guaranteed by the Regulation is not compromised during the transmission of personal data to third countries or international organizations.
