On November 16, 2021, the E.U. Court of Justice, with the judgment in case C-479/21 PPU, after being called to determine whether Ireland was required to execute the European arrest warrants issued by the United Kingdom despite the withdrawal of that State from the European Union, clarified that Ireland is directly obliged to apply the European arrest warrant regime against the United Kingdom in the transition period, as provided for in the Withdrawal Agreement and regarding the new surrender mechanism in the agreement on trade and cooperation between the E.U. and the U.K. It also ruled out that Ireland could choose to be subject to these rules or to refuse them because the inclusion of these provisions in the aforementioned agreements did not justify the addition of a legal basis relating to the area of freedom, security and justice for the purposes of concluding these agreements, with the consequence that these provisions did not require that Ireland could choose to be subject to them or not.
