Directive (EU) 2019/790 on copyright and related rights in the digital single market stems from the need to update the E.U. legislation on copyright as dictated by Directive 2001/29EC, “old” now by almost twenty years and issued when the internet was only in its infancy trying to balance the interests of users through a wide access to online content and the subjects that provide this content. The negotiation that led to its approval was particularly long and difficult. Among its objectives: fair remuneration to authors who license or transfer the rights to use their works, precise definition of “very short extracts”, in compliance with the free circulation of information, to recognize the right of publishers to request remuneration for the digital use of their publications. The implementation of the measure is expected by 7 June 2021, based on the provisions of the European delegation law 2019-2020.
