On 2 September 2020, the E.U. Court, with the ruling in case C-514/19 established that a member State can prohibit the use of active substances authorized by Regulation (EC) no. 1107/2009, concerning plant protection products, if it has previously communicated it to the Commission, clarifying the reasons and urgency, without receiving a reply. The practical case arose from the fact that France had correctly informed the Commission (in the forms provided for by Directive (EU) 2015/1535) of the need to adopt suitable and appropriate measures on the matter of French bees.
