On 28 April 2020, in Ukraine, the law n. 361-IX of 6 December 2019 which introduces new rules on the disclosure of information relating to beneficial owners (UBO) of legal entities came into force to prevent and combat the legalization (laundering) of proceeds from crime, terrorist financing and the spread of weapons of mass destruction. Upon registration or modification of information relating to a company, the applicant will be required to provide the company register with the property data and documents that identify the actual beneficiary of a company (for example: a copy of the passport).
Companies registered before 28 April 2020 will be required to provide the state register with information on their beneficial owners within three months of the entry into force of the legislation in question. It is expected that the information on the beneficial owner will then have to be constantly updated, probably annually. The new law also increases the amount of the fine that may be imposed on a company for not having provided information on its beneficial owners to the register, or for not having sent the documentation aimed at confirming the information previously provided.
