20/12/2019 - WTO to renew its Appellate Body; the US addresses its concerns

On the 10th of December 2019, two of the mandates of the members of the WTO Appellate Body expired, leaving such body, which has a normal composition of 7 members, with a member only. Consequently, a group of World Trade Organization members issued a joint call to begin the selection processes for filling Appellate Body considerable vacancies. Specifically, Mexico argued that the considerable number of members submitting the proposal (119) reflects a common concern over the current situation in the Appellate Body that is seriously affecting the dispute settlement system against the best interest of all members. Furthermore, the United States claimed that it was still not in the position to support the decision and that the systemic concerns that it previously identified remain unaddressed; the fundamental problem being that the Appellate Body is not respecting the current, clear language of the WTO’s Dispute Settlement Understanding. The US maintained that it intends to propose and draft new WTO reforms, in order to improve the WTO’s negotiating functions.
