On 24 March 2022, the Court of Justice of the European Union with a sentence rendered in case C-533/20 clarified the question of the indication of the vitamin formula within the list of ingredients. In particular, it established that in the event that a vitamin has been added to a food, the list of its ingredients must not include, in addition to the name of the vitamin, the name of the vitamin formulas specifically used. The question arose from the doubt of the Hungarian Supreme Court which asked the E.U. Court of Justice whether the list of ingredients shown on the label of an enriched food product (in the case: margarine enriched with vitamins) should include, in addition to the denomination of the category of added vitamin, also the indication of the vitamin formulations specifically used together itself. In the E.U., the discipline is harmonized as regards the rules on the addition of vitamins and minerals to foods with Regulation (EC) no. 1925/2006 that includes the list of formulas to be considered permitted in relation to the vitamins indicated in the positive list of Annex I of the same. The Court of Justice has been called upon to give a preliminary ruling on the interpretation of Regulation (EU) no. 1169/2011 on the subject of labelling. To avoid objections and reduce the risk of fines, companies must therefore comply with the aforementioned interpretation of the Court of Justice for the labels of fortified food products. In this regard, it should be remembered that these requirements do not apply only to foods enriched with vitamins, but also to those containing mineral salts.
