On September 27th, 2022, the European Securities and Markets Authority (ESMA), the EU’s securities markets regulator and supervisor, issued a new Report on the distributed ledger technology pilot regime with which the regulator intends to offer guidance for what concerns technical elements and, on the same time, it provides advice and recommendations on compensatory measures on supervisory data. The Report is also the result of the opinion received by ESMA within the Call for Evidence process launched in January and a subsequent workshop which was organized to that purpose in March. The outcome of the Report is that there is no need to modify the Regulatory Technical Standards on transparency and data reporting requirements before the DLT Pilot starts applying in March 2023. In the meantime, ESMA has the intention of working on supervisory guidance clarifying the application of certain elements of the RTS on transparency and data reporting requirements and to issue guidance on questions received by different stakeholders on the DLT Pilot to contribute to its application.
