In September 2022, the Commission adopted two proposals to adapt liability rules to the digital age, the circular economy and the impact of global value chains. First, it proposes to modernize existing strict producer responsibility rules for defective products (from smart technology to pharmaceuticals) to give businesses legal certainty so that they can invest in new and innovative products and ensure that consumers harmed by defective products, including refurbished digital products, are eligible for fair compensation. Secondly, Brussels proposes a targeted harmonization of national liability rules for artificial intelligence, making it easier for victims of damage to obtain compensation. The new rules will ensure that victims can benefit from the same standards of protection when harmed by artificial intelligence products or services, as they would if the harm were caused under any other circumstance.
