On 9 July 2020, the E.U. Court of Justice, in the ruling stated in the joined cases C-698/18 and C-699/18 facing a Romanian case in application of Directive 9313/EEC, argued that consumer protection against unfair terms in contracts with professional operators it must be "effective", without therefore exposing the weaker contractor to the risk of being cut off too early due to the prescription, thus preventing him from taking any action for recourse.
