On 24 October 2019, in the judgment given in case T-601/17 Rubik’s Brand/Euipo - Simba Toys, the Court of the European Union confirmed the annulment of the European Union trademark consisting of the form of Rubik’s cube, since the essential characteristics of this form are necessary to obtain the technical result consisting in the rotation capacity of this product. This form could not have been registered as a European Union trade mark.
