Articoli Correlati: permanent disability - working father - supplementary pension

On 10 September 2019, the E.U. Court of Justice’s lawyer intervened in the case C-450/18 to provide clarifications regarding the possibility for a father of two daughters to benefit from the integration of the old-age contributory pension, for widows or disability permanent, provided for by Spanish law for women who have had two or more biological or adoptive children. In his conclusions, he noted that according to the principle of equal treatment between men and women in matters of social security, it appears contrary to the european law a national measure which, on the one hand, confers the right to receive a pension supplement for women who have two or more children and, therefore, the right to obtain a contributory permanent disability pension after its entry into force, but, on the other hand, does not provide any possibility of recognizing this right to men in any situation.
