In a recent decision, the Euipo examined the case relating to the opposition to the application for registration of the word mark “Exceed your limits” in the light of Article 8 (1) (b) EUTMR and Article 8 (5) EUTMR indicating the need for proof of the reputation of the earlier mark in relation to the goods and services for which it is registered.
