With the internationalization of society, an increasing number of individuals are likely to possess assets outside the State. The establishment of permanent powers of attorney (LPA), or an equivalent document, is useful to allow third parties to deal with activities abroad. These documents provide legal authority to the attorney chosen to deal with a person’s business, when they are unable to manage them, for example, due to health problems or loss of mental or physical capacity. To be accepted, it will be required: a certified copy of the LPA, attested by a notary with an apostille attached by the Foreign and Commonwealth Office, a translated version of the LPA in the local language - a notarial certificate can be requested, in addition to certifying the translation .
The United Kingdom is a signatory of the Hague Convention on the subject, even if it has not yet been ratified, and therefore the Convention does not yet have legal effects.
