The rule of law is one of the common values ​​on which the European Union is founded: a value shared by all Member States and enshrined in Article 2 of the Treaty on European Union. The communication takes stock of the situation on the instruments available for monitoring and protecting the rule of law in the Union and traces the experience of past years with the aim of further strengthening it in the future. In particular, past experience highlights need for better promotion, early prevention of risks or violations regarding the rule of law. The first Vice-President Frans Timmermans said: “Today more than ever it is essential for the Union to be able to guarantee respect for the rule of law. Firstly, because it is a question of fundamental rights and our identity. secondly, because the functioning of the EU depends on respect for the rule of law in all Member States. It is the common responsibility of the EU institutions and all Member States to defend, strengthen and guarantee full respect for the rule of law in the Union. The Commission has already used many tools including the framework for the rule of law, the procedures referred to in Article 7 (1) of the TEU, the infringement procedures, the European semester, the EU scoreboard of justice. The Commission now invites the European Parliament, the European Council, the Council and the Member States to reflect on the problems presented in the communication and to contribute concrete ideas on how to further promote the current instruments on the rule of law.
