The new law on “export control” adopted by the People’s Republic of China on 1 December 2020, the Export Control Law of the People’s Republic of China, will have a strong impact on national and E.U. operators. The rules and obligations are increasing: the importing company will have to provide new certifications to its business partner, as well as undertake to the Chinese authorities not to use the controlled products (dual-use goods, technologies and services) for purposes other than those certified, ensuring that they will not be delivered to third parties without the consent of the authority that issued the export authorization. In addition, the Chinese authorities will be able to provide for injunctions on commercial relations and the inclusion in a black list for importers who violate the new provisions.
